Product Pricing and Availability
The Products displayed on this Site are subject to availability. The Company reserves the right, without prior notice, to discontinue or change pricing or specifications on Products and services offered on this Site without incurring any liability whatsoever.
Colours
We have made every effort to display as accurately as possible the colours of the Products that appear on the Site. As the actual colours you see will depend on your computer’s monitor we cannot guarantee, however, that your monitor's display of any colour will be accurate.
Intellectual Property
All intellectual property rights, including copyright, in all materials, including trademarks, logos, photographs, images, text and other graphics which form part of the Site are owned by the Company alternatively the Company is the lawful user thereof. Such rights are protected by both South African and international intellectual property laws. All data and information communicated to or from the Site and/or any Site information as well as the database is the sole property of the Company.
The Company grants you permission to view, electronically copy and print portions of the Site for the sole purpose of placing an order with the Company for any of the Products.
Any use of materials on the Site other than for the purpose noted above including, without limitation, the unauthorised submission, removal, modification, dissemination, copying or distribution of copyrighted or other proprietary content, without the prior written consent of the Company and/or the lawful trademark and/or copyright owner (if applicable), is prohibited and constitutes an unlawful infringement of the intellectual property rights of the Company and/or such trademark and/or copyright owner.

"Brand Name Marketing", the Brand Name Marketing logo as well as the Company logo and all other marks, logos and trade names appearing on this Site are trademarks of either the Company, its holding company or affiliates in the Republic of South Africa, or of third parties who have authorised the Company to display such trademarks on the Site. Nothing contained on this Site should be construed as granting, by implication or otherwise, any license or right to use any of the trademarks displayed on this Site without the express prior written consent of the Company. Your use of any of the trademarks displayed on the Site or in any of its contents is strictly prohibited. You may not copy, reproduce, publish, upload, post, transmit, distribute or modify any of the trademarks appearing on this Site. You further undertake not to infringe any right of the Company or trademark owners in respect of such trademarks. The use of the trademarks on any other website or networked computer environment is prohibited.
Unlawful use
You shall not use this Site to send or post any message or material that is unlawful, harassing, defamatory, abusive, threatening, obscene, sexually orientated, racially offensive, profane or which violates any applicable law and you hereby indemnify the Company against any loss, liability, damage or expense of whatever nature which the Company or any third party may suffer and which is caused by or attributable to, whether directly or indirectly, your use of the Site.

No person, business or other website may link to any page on this Site without the prior written permission of the Company.
External hyperlinks may be provided on the Site, but such links are beyond the Company’s control. Disclaimers and Exclusions of Liability
You expressly agree that use of the Site is entirely at your own risk. The Site and its contents are provided on an ‘as is’ and ‘as available’ basis and has not been compiled to meet individual requirements. It is your responsibility to satisfy yourself, prior to entering into this Agreement, that the service available from and through this Site meets your requirements, and is compatible with the hardware and/or software used by you.
The Company makes no representations nor gives warranties of any kind, whether express or implied including, without limitation, with respect to the Site, its contents, the accuracy thereof or any warranties or representations regarding the effectiveness of any security or encryption facilities or with regard to the availability of Products and/or delivery arrangements and times.
The Company disclaims all representations and warranties including, but not limited to, warranties as to the availability, accuracy or content of information, Products or services, and warranties of merchantability or fitness for a particular purpose of information, goods or services.
The Company does not warrant that the functions provided by the Site will be uninterrupted or error free, or that the Site or the server that makes it available are free from viruses or other harmful components. Save as expressly set out herein, the Company shall under no circumstances whatsoever be liable to you, including without limitation, as a result of or in connection with the Company’s negligent acts or omissions or those of their employees, agents, representatives, sub-contractors or other persons for whom in law they may be liable (in whose favour this constitutes a contract or undertaking for their benefit), for any direct, indirect, incidental, special or consequential loss or damage of any kind whatsoever or howsoever caused (and whether arising under contract, delict or otherwise), sustained by either you, the recipient of the Products or services or any other person arising from or as a result of any sale concluded in terms of this Agreement, the delivery, non-delivery, incorrect, erroneous or late delivery, the use or possession of the Products or services.
The Company, its directors, employees, sub-contractors, agents, representatives, affiliates and suppliers shall not be liable for any loss, damage (whether direct, indirect or consequential) or expense of any nature whatsoever which may be suffered as a result of or which may be attributable, directly or indirectly, to the use of or reliance upon the Site (including any information contained thereon) or the Internet. You hereby indemnify the Company from and against any loss or damage suffered or liability incurred including, without limitation, in respect of any claim or demand by any third party by reason of any act or omission on your part or that of any family member, agent or representative acting on your behalf in connection with transactions concluded on the Site and/or in terms of this Agreement and/or in relation to the receipt of Products or services supplied by the Company pursuant to any such order.
Notwithstanding any other provisions contained herein, the Company's liability whether in contract or delict arising from any breach of any obligation in terms of this Agreement, negligence or otherwise shall not exceed at any time the value of the Product(s) in respect of which any such dispute or claim arises.
By accessing this Site you warrant and represent to the Company that you are legally entitled to purchase the Products and that all the details you have provided are true and complete.

1. PRICES
1.1 Subject to the provision of the clause 1.3 below, the price of each Discovery Online Brandshop product is displayed on the Discovery Online Brandshop website alongside the product concerned and is quoted in South African Rands (ZAR). In the event of a sale special offer, the discounted price is the displayed.
1.2 Prices displayed EXCLUDE VAT and are subject to change from time to time. Prices changed to you upon placement of an order will be changed inclusive of VAT and delivery charges, if applicable.
1.3 We shall make all reasonable efforts to procure that the prices displayed on the Discovery Online Brandsahop website are correct as at the time of display.
1.4 In the event that products are displayed alongside incorrect prices, however, we will not be obliged to sell the products in question at the prices alongside they were displayed, but shall only be liable to refund to you the difference between the correct price which the product were purchased, where the purchase, where the purchase price paid exceeded the correct price.
2. SHIPPING AND DELIVERY COSTS
The cost of shipping within the borders of South Africa will be shipped at a standard 72 hour delivery service within Major City Centre’s (as per Schedule C) to areas outside city center’s.
For all orders OVER the value of R1000 (excl.VAT), shipping costs are FREE

The risk of damage to, destruction or theft of Goods shall pass to DISCOVERY or the purchaser on delivery and acceptance by DISCOVERY or the purchaser of the Goods at the agreed delivery or receipt address. BNM undertakes to comprehensively insure the Goods for in transit.

- Value added tax (VAT) at the rate of 15% is included in the shipping price charged on goods bought by South African residents.
- Shipping costs outside the borders of South Africa will be for purchasers own account.
- The purchaser will have the ability to collect the goods from BNM themselves at NO CHARGE.
- PLEASE NOTE: Goods can only be collected once payment is received or on a corporate order - it is an authorized order, i.e. an order which was paid via a Discovery Cost Center and approved with a Purchase Order which would have been approved by a Cost Center manager

3. DELIVERIES
Inside the borders of South Africa
- All items of the DISCOVERY Store site will be delivered according to service level agreement, Schedule C attached hereto.
- Delivery to Discovery’s 8 locations would be FREE of charge on a weekly basis. Sandton, would be delivered daily. Delivery to any other location on orders over R1000 ex VAT is free. All orders under R1000 ex Vat will carry R100 delivery fee.
- Goods purchased on the DISCOVERY Store site over Weekends and Public Holidays will be sent 48hours from the first working day thereafter, i.e. goods purchased over weekends will be delivered the Tuesday thereafter.
- Any person other than the person who ordered the goods who receives the goods at the delivery address is conclusively presumed to be authorised to accept delivery on behalf of the person who ordered the Goods.
- Should no one be in attendance at the time of pre-arranged delivery, the goods will be returned to BNM and a notice will be left at the delivery address to this effect. The person who ordered the goods will be required to contact BNM’s Call Centre to make new arrangements for delivery or collection.
- BNM reserves the right to charge an additional Delivery Fee should it be required to make a further delivery if no one is at the pre-arranged delivery address to receive the goods on the agreed Delivery day.
- BNM's liability for failing to deliver the goods during the agreed Delivery day, or at all, is limited to the goods being delivered at a later agreed time at no additional charge.
- The person who ordered the goods is required to ensure that an authorised person shall be in attendance at the delivery address during the agreed Delivery day and that appropriate access will be made available to the Delivery team.
- On delivery, the person accepting delivery shall be required to sign and print his/her name on the accompanying delivery slip to confirm receipt of the delivery of goods in perfect condition.
- With the exception of online orders, no personal deliveries will be made to employee house addresses. All deliveries will be delivered to the DISCOVERY branch at which the employee is employed.
The risk of damage to, destruction or theft of Goods shall pass to DISCOVERY or the purchaser on delivery and acceptance by DISCOVERY or the purchaser of the Goods at the agreed delivery or receipt address. BNM undertakes to comprehensively insure the Goods for in transit.
5. RETURNS
- All returns must be dealt with in accordance with BNM’s return policy. Such return policy must be consistent with the Consumer Protection Act. 68 of 2008
- On delivery of the goods to the delivery address, the person taking delivery at the delivery address or at any other place of delivery will be required to confirm acceptance of the delivery by signing the accompanying delivery slip.
- If the client is for any reason dissatisfied with an item purchased they may return it at their own cost via courier to the following address: Unit 3 Lakeside Park, Lakeside Place, Capricorn Business Park, Muizenberg 7945.
- A copy of the proof of purchase must be included with the parcel which is to be returned in the original packaging.
6. CUSTOMER PRIVACY POLICY
- Brand Name Marketing collects voluntarily personal information of individuals and corporate entities with whom it works in order to operate and carry out its business effectively. We regard the lawful and appropriate processing of all personal information as crucial to successful service delivery and essential to maintaining confidence between Brand Name Marketing and those individuals and entities in which we deal with. Any personal information that you send us will be used for the intended purpose and adhered to the principles of the Protection of Personal Information Act (POPI). - For the purpose of this clause, "personal
information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: http://www.polity.org.za/attachment.php?aa_id=3569.
7. PAYMENT OPTIONS ACCEPTED
- Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Brand Name Marketing bank account, thedetails of which will be provided on request.
- Card transactions will be acquired for Brand Name Marketing via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
- Customer details will be stored by Brand Name Marketing separately from card details which are entered by the client on DPO PayGate’s secure site.
For more detail on DPO PayGate refer to www.paygate.co.za. - The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
8. COMPANY INFORMATION
